TAKE NOTICE that the Corporation of the Town of St. Marys has received Applications for approval of Official Plan and Zoning By-law Amendments (by the Corporation of the Town of St. Marys, Files OP01-2019 and Z01-2019) pursuant to Sections 22 and 34 of the Planning Act R.S.O. 1990 and has deemed same to be complete pursuant to the provisions of the Planning Act R.S.O. 1990.

The Town’s Planning Advisory Committee will be reviewing the Applications at its regular meeting scheduled on Monday, January 21, 2019 at 6:00 p.m. in the Municipal Operations Centre (408 James Street South) and you are invited to attend this meeting. The proposed Amendments affect the subject property located at 481 Water Street South and is described as Part of Lot 35, Thames Concession in the Town of St. Marys.

The subject property fronts onto the west side of Water Street North, between Church Street South and Washington Street, as shown on the General and Specific Location Maps included with this Notice. The property is 1,539.3 m2 (0.15 ha) in size with approximately 58.8 metres of frontage.

The Town designated the subject property under the Ontario Heritage Act in 2008. The Alexander McDonald House is located on the property. The Town currently owns the property and submitted the Applications to amend the Town’s Official Plan and Zoning By-law with respect to the property. The Town has declared the property to be surplus to its needs and is seeking to sell the property.

According to the Town’s Official Plan, the subject property is currently designated “Recreational” (Schedule A) and a “Natural Hazards Constraints Area” is identified on the rear portion of the property (Schedule C). The subject property is currently zoned Institutional (I-4) and identified as “Heritage Classified” (for information purposes) in the Town’s Zoning By-law Z1-1997. The purpose and intent of the Applications is to change the Official Plan designation of the subject property to “Highway Commercial” and change the zoning of the subject property to “Highway Commercial Zone (C3)” with site specific Official Plan policies and Zoning By-law regulations to permit:

• The following uses: business or professional office, convenience store or variety store, equipment sales and rental business, laboratory or research facility, private club, production studio (premises used for producing motion pictures, or audio or video recordings or transmissions), restaurant, and accessory uses, buildings, and structures.

• A minimum front yard of 5 metres whereas Section 17.1.2 D of the Zoning By-law requires 10 metres;

• A minimum interior side yard of 2.5 metres whereas Section 17.1.2 E of the Zoning By-law requires 7.5 m or one half the building height, whichever is greater; and,

• A minimum rear yard of 2.5 metres whereas Section 17.1.2 G of the Zoning By-law requires 7.5 m.

ANY PERSON may attend the public meeting and/or make written or verbal representation either in support of or in opposition to the proposed Official Plan or Zoning By-law Amendments. Please note that the Planning Advisory Committee meeting scheduled on Monday, January 21, 2019 is not the required public meeting under the Planning Act. At this meeting, the Planning Advisory Committee will review the Applications, consider information and comments provided by the applicant, Town staff and the public, and make recommendation(s) to Council with respect to the further processing of the Applications (e.g. setting a public meeting date under the Planning Act).

Please note: Comments and opinions submitted on these matters, including the originator’s name and address, become part of the public record, may be viewed by the general public and may be published in a Planning Report and will be included in the Council agenda and minutes. Council agenda and minutes are published on the Town of St. Marys website.

If a person or public body would otherwise have an ability to appeal the decision of the Council of the Corporation of the Town of St. Marys to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Town of St. Marys before the proposed official plan amendment is adopted or the by-law is passed, the person or public body is not entitled to appeal the decision.

If a person or public body does not make oral submissions at a public meeting or make written submissions to the Council of the Town of St. Marys before the proposed official plan amendment is adopted or the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

If you wish to be notified of the decision of the Town of St. Marys on the proposed Official Plan Amendment or Zoning By-law Amendment, you must make a written request to the CAO-Clerk of the Town of St. Marys (Brent Kittmer).

ADDITIONAL INFORMATION relating to the proposed Official Plan Amendment and Zoning By-law Amendment is available for inspection during office hours at the Town of St. Marys Municipal Operations Centre and can be provided in an accessible format upon request.
